eSign consent and biometric collection policy

1. Consent to electronic records

By checking the eSign consent box on the business purchase page or otherwise transacting with Sales Incentive Network electronically, you consent to receive and sign records electronically under the United States E-Sign Act (15 U.S.C. § 7001 et seq.), the Uniform Electronic Transactions Act (UETA) as adopted by the State of Wyoming and other applicable U.S. states, and equivalent electronic transaction laws in Canada (PIPEDA and provincial Electronic Commerce Acts), the United Kingdom and European Union (eIDAS Regulation), Australia (Electronic Transactions Act 1999), Mexico (Ley de Firma Electrónica Avanzada), and the relevant statutes of the Latin American jurisdictions in which you reside.

"Records" includes order confirmations, certificates, incentives, receipts, terms of service, privacy notices, billing statements, communications consents, and any other document we are required or choose to provide to you in connection with our products and services.

2. Consent to electronic signatures

You agree that any of the following constitute your valid electronic signature, with the same legal effect as a handwritten signature on paper: (a) clicking a checkbox labeled as an agreement, consent, or acceptance; (b) clicking a button labeled "Continue to secure checkout," "I agree," "Submit," or similar; (c) typing your name into a signature field; or (d) drawing a signature with a pointer or touchscreen.

You confirm that you have the authority to bind yourself, and where you act on behalf of a business, the authority to bind the business, to the agreements you electronically sign.

3. Hardware and software requirements

To access and retain electronic records, you need: a current internet browser that supports TLS 1.2 or higher; a valid email address; sufficient storage to save records or a printer to print them; and a device capable of opening PDF documents. By consenting, you confirm that you have access to such hardware and software.

4. Withdrawing consent

You may withdraw your consent to receive records electronically at any time by emailing [email protected] with the subject line "Withdraw eSign Consent." Withdrawal is prospective only: it does not affect the validity of records you previously signed or received electronically. After withdrawal, certain online services and the incentive product may no longer be available to you.

5. Biometric collection policy

In limited circumstances we may collect biometric identifiers or biometric information ("biometric data") in connection with verifying your identity, preventing fraud, or fulfilling certain orders. Biometric data we may collect includes:

• A facial likeness derived from a photograph or photo identification
• A voiceprint derived from a recorded phone call used for verification
• A handwritten signature image where used as part of fraud prevention

Purpose. We use biometric data solely to verify identity, prevent fraud and chargebacks, and complete fulfillment of business orders. We do not sell, lease, trade, or otherwise profit from your biometric data.

Retention. We retain biometric data only for as long as needed for the purpose collected, and in any event no longer than three (3) years from the date of your last interaction with us, after which we permanently destroy it. Where state law requires shorter retention or earlier destruction (for example, the Illinois Biometric Information Privacy Act, Texas Capture or Use of Biometric Identifier Act, Washington Biometric Privacy Law, or similar), we comply with that law.

Storage. Biometric data is stored using industry-standard encryption at rest and in transit, segregated from general customer data, and accessible only to personnel and processors with a documented need to know.

Disclosure. We do not disclose biometric data to third parties except: (a) to the subject of the data; (b) where disclosure is required by a valid warrant or subpoena; (c) to a service provider acting on our behalf under a written contract that prohibits further use; or (d) where disclosure is required by law.

Consent. By checking the eSign and biometric consent box on the business purchase page, you consent to the collection, storage, and use of your biometric data as described in this policy.

6. Updating contact information

You agree to notify us promptly of any change to your email address, phone number, or postal address by emailing [email protected].
